Foreign investors and infrastructure owners and operators should consider the impact of the Critical Infrastructure Centre and the recently enacted Security of Critical Infrastructure Act 2018 on their existing and potential investments.
The UK is now considering, and is expected to adopt, a new foreign investment regime that will give the Government greater powers of intervention . A recent investment in a nuclear power station building project, known as Hinkley Point, involving entities owned or part-owned by France and China, appears to have cemented the issue. The Foreign Investment Review Agency (FIRA) was established by the Canadian Parliament in 1973 to ensure that the foreign acquisition and establishment of businesses in Canada was beneficial to the country. The Foreign Investment Review Act that created the agency was the culmination of a series of government reports and debates.
